Welcome to MyBriefy.com, a service provided by Global Titan Digital Marketing ("Company", "we", "us", or "our"). By accessing or using MyBriefy ("Software"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Software.

1. Account Registration

To use MyBriefy, you must create an account. During registration, you will be required to provide your name, email address, Discord username, job position, company name, and create a password. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

2. User Responsibilities and Restrictions

User Responsibilities:

• Providing Accurate Information: Users must provide accurate and truthful information when creating an account.
• Account Security: Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
• Compliance with Terms: Users must comply with these Terms and all applicable laws and regulations.
• Content Responsibility: Users are responsible for the content they upload, share, and post, ensuring it does not violate any laws or third-party rights.
• Respecting Intellectual Property: Users must respect the intellectual property rights of others and not use the software to infringe upon those rights.
• Proper Use of the Software: Users must use the software in a manner that does not harm, disrupt, or interfere with the software's operation or other users' enjoyment of the software.

User Activities:

• Users can create briefs, fill out briefs, share them with clients, and post updates related to their clients at their discretion.

Prohibited Activities:

• Each user is allowed only one account. Creating multiple accounts to abuse the “free account” limit is prohibited. If an error occurs and you need to prove you are a different person, please email us with proof at headpanda@mybriefy.com.
• Users must not engage in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Users must not upload or share content that contains viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any software or hardware.

3. Fees and Payments

MyBriefy offers both free and paid subscription plans. Users can upgrade their subscriptions as needed. Payments are processed through Stripe. Billing cycles are as indicated on the user's admin dashboard and differ per company, typically occurring within 30 days of upgrade or sign-up. Taxes and fees are agreed upon based on the chosen plan and may vary. If a user fails to pay by the deadline, their account will be downgraded to the free plan. Subscription fees are non-refundable.

4. License to Use

Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Software strictly in accordance with these Terms.

5. Content and Intellectual Property

Users can upload content and type updates on their clients. The Company does not claim ownership of the content uploaded by users. However, by uploading content, users grant the Company a worldwide, non-exclusive, royalty-free license to use, distribute, reproduce, and display such content solely for the purpose of providing the Software.

6. Termination and Suspension

Account Termination:

• Users can delete their accounts at any time. If all accounts under a company are deleted, all associated data will be deleted as well.
• If a user cancels their subscription, they can delete their account. If they delete their account but other users in their organization remain active, the data they uploaded and typed will remain accessible to the organization.

Account Suspension:

• Accounts will be suspended if a user creates more than one account to abuse the free account limit.
• Accounts may also be suspended for engaging in any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable behavior.
• Suspensions may occur if users upload or share content that contains viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any software or hardware.
• Accounts will be suspended for violating intellectual property rights.
• Accounts may be suspended for spamming or attempting to manipulate the Software's functionalities.
• Users may be suspended for any activity that disrupts or interferes with the Software's operation or other users' enjoyment of the Software.
• Users can email us at headpanda@mybriefy.com with proof to resolve mistaken suspensions.

7. Disclaimers and Limitations of Liability

Disclaimers:

• We are not responsible for bugs, software issues, or things breaking. We will do our best to restore functionality as quickly as possible.
• We are not liable for data that users delete. Deleted data cannot be recovered.
• Users are responsible for backing up their data.
• We are not liable for any outages or issues related to Bubble.io.

Limitations of Liability:

The Company has zero liability for any code breaking, indirect damages, or user mistakes. Our maximum liability is limited to the amount paid by the user for the Software, if any.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorneys' fees) relating to or arising out of your use of the Software, your violation of these Terms, or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations.

9. Privacy

Your use of MyBriefy is also governed by our Privacy Policy, which outlines how we collect, use, disclose, and safeguard your information. Read the Privacy Policy.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kentucky, USA, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through email communication. If resolution cannot be reached, disputes shall be settled in the courts of Kentucky, USA.

11. Amendments

We may update these Terms from time to time. If we make significant changes, we will notify you via email. Your continued use of the Software after any changes to these Terms will be deemed your acceptance of those changes.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
